  1. Definitions

    Candidates: means any person which applied to a job offer or submitted a spontaneous application.
    Company:means an entity among the Baracoda group for which a recruitment is contemplated.
    Data Controller: is the person or entity that determines the purposes and means of processing personal data.
    Personal data: is any information, directly or indirectly, relating to an identified or identifiable individual.
    Privacy Statement: means this document.
    Services: means together all websites, applications, products and services provided by Baracoda or by a Company.


  2. Purpose of this Privacy Statement

    The following rules apply to Candidates. However the use of the Services is ruled by another set of privacy rules accessible on our website https://baracoda.com/.
    When you apply to a job offer or when you submit a spontaneous application, you hereby accept the rules contained in this Privacy Statement and hereby confirm that you have red it and accept it without reserve.
    We might provide modification to the terms contained in this Privacy Statement from time to time as to comply with the law or with respect to any case-law developments. You are hereby invited to check this page regularly in order to make sure that you agree with any modification we could provide.


  3. Who are we?

    Baracoda and its affiliated Companies are French companies having registered office at 115-123 avenue Charles de Gaulle à Neuilly-sur-Seine (92200), (together referred to as “Baracoda”).
    Baracoda and the Company concerned by the recruitment are joint Data Controllers of the processing of your Personal Data.


  4. Personal data we collect

    This Privacy Statement applies to Personal Data you provide to Baracoda or that Baracoda may collect when you apply, or when we contact you in view of a potential recruitment. Those Personal Data might include:
    • Data regarding your identity: your name, surname, date of birth, photo ;
    • Data regarding your contact details: your home address, your email address, your phone number and other relevant contact information ;
    • Data related to your career (as might be included in your resume and/or cover letter) : your academic background and qualifications, your professional background and any other information you might provide us with as part of the application process;
    • Information submitted during phone calls, videoconferences, or on-site interviews: including information related to the position you are looking for, your current salary and your salary expectations; as well as informations related to your profile analysis;
    • Sensitive data such as your gender, nationality, a potential disability if you decide to share with us such information;.
    • If you were to accept a potential offer we could make: your social security number, a copy of your ID, data related to your nationality and if relevant to your work authorization on the territory for which the position is considered.

  5. Those Personal Data can also include other information you might provide us with during the selection process.

  6. Why do we collect and process your Personal Data?

    On the basis of the legal basis mentioned in the table below, we collect and process your Personal Data for the following purposes:

  7. Personal data retention

    When you share with us your personal data when filing the “Contact Us” form, we keep your personal data for as long as necessary to process such questions/requests and once they do not represent a business opportunity any more, but no more than two (2) years following the latest contact between you and CareOS.


  8. Who can access your Personal Data?

    Some of your Personal Data can be transferred or made accessible by third parties: professional social networks (e.g., Linkedin), platforms (e.g.,Welcome to the Jungle), recruitment agencies or by references (with your approval).
    For the purposes mentioned above, we might transfer your Personal Data to our affiliates.
    Baracoda might also use service providers to execute some of the purposes defined in the section above (e.g., a recruitment agency).
    Furthermore, Baracoda might transfer your Personal Data to our external counsels and to government authorities if deemed necessary.


  9. For how long do we keep your Personal Data?

    At the end of the application process, if your application is successful, we will add your Personal Data to your employee or intern file. The “employees privacy policy” shall then apply to your Personal Data.
    However, if your application is unsuccessful, we shall keep your Personal Data during a certain period of time as to make sure we can provide you with a reason justifying such refusal.
    If you consent to be part of our talent pool,we shall keep your Personal Data two (2) years following our last contact.


  10. Security measures

    During the recruitment process, only the following person can access your Personal Data:
    • The HR team of Baracoda,
    • General management of Baracoda,
    • The manager of the Company concerned by the recruitment as well as any other member of the team that could be concerned by such recruitment.

    Barracoda is committed to protecting its candidates’ Personal Data. We implement appropriate technical and organizational measures to help protect the security of your Personal Data.


  11. Your rights

    You have the following rights regarding your personal data:
    • Access: you have the right to (i) access your personal data, to (ii) obtain confirmation as to whether personal data concerning you is processed or not and, if processed, to (iii) obtain access to such data and a copy thereof;
    • Rectification: you have the right to obtain the rectification of any inaccurate personal data concerning you. You also have the right to have incomplete personal data completed, including by means of providing a supplementary statement;
    • Erasure: in some cases, you have the right to obtain the erasure of personal data concerning you. However, this is not an absolute right and CareOS may have legal or legitimate grounds for keeping certain data for the provision of the Service;
    • Restriction: in some cases, you have the right to obtain restriction of the processing of your personal data;
    • Data Portability: you have the right to receive the personal data concerning you which you have provided to CareOS, in a structured, commonly used and machine-readable format, and you have the right to transmit those data to third parties without hindrance from CareOS. This right only applies when the processing of your personal data is based on your consent or on a contract and such processing is carried out by automated means;
    • Object: you have the right to object at any time, on grounds relating to your particular situation, to processing of personal data concerning you when such processing is based on the legitimate interest of CareOS. CareOS may, however, invoke compelling legitimate grounds for continued processing;
    • Complaint: you have the right to contact the supervisory authority to complain about CareOS’ personal data protection practices (in France you may contact the CNIL).
    • To exercise one or more of these rights, you can contact us at the email address indicated in section 12. In the event that you are not satisfied by our answer to your request, you are entitled to contact the personal data protection authority concerned.
